2012 E70 35d X5 factory or tuned ?

Purchase 35d X5 '12 and dont know whats been done to it since it was a trade in and dealer doesnt have much info.
I did a read and just wondering if anyone can see whats been changed if anything ?

Reason im asking is I see the swirl flaps have been capped off so guess it doesnt need a tune for that.
I have been getting a CEL since purchase that is P2457/4873 regarding EGR cooler. Clear it and comes back after less than 100 kms.
So looks like I need a swirl flap and EGR tune a this point with adblue/Def disable for bonus.

Local tuner put this onto it but threw CEL again, I told him Swirl and EGR at least , but who knows what he did if anything.
